Account Setup / Email on File
Once we have received payment and verified the order details for potential fraud, we will proceed to set up your account. For security reasons, we kindly request that you supply us with an email address separate from the domain(s) you are using to sign up. Please be informed that the primary email address on file will be utilized in the event of an abuse concern or any other necessity to contact you. You should always make sure the email address that is recorded is current or recent. You are responsible for maintaining accurate and up-to-date contact information for your domain account and the domain name(s) itself if you have the domain registered with Sana Cloud. Due to connected contact information being outdated, Sana Cloud is not held liable for a domain registration that has lapsed. Just shoot an email to our sales staff if you need anything changed or verified. Your account may be suspended or terminated if you provide inaccurate contact details. The purchase of dedicated servers or other high-risk transactions may necessitate the presentation of government-issued identification documents, including a copy of the relevant credit card billing statement. You risk having your order rejected due to suspicion of fraud if you do not adhere to these guidelines.
Transfers
If your former host is using cPanel, you can take advantage of our free transfer services for 30 days after you sign up. There may be a migration cost if your previous employer used an uncommon control panel. If you need a transfer done beyond the 30-day free period, we can help you out with that. Just give us some specifics, and we’ll give you a price quote.
If you need assistance transferring your site to us, our transfers team is here to help. We do not guarantee the availability, feasibility, or completion time of account transfers, and they are offered as a courtesy service only. Since every hosting provider has their own unique setup and some platforms use proprietary or incompatible data storage formats, migrating some or all of your account information could be a daunting task. While we will do our best to help you transfer data from an old host, there are situations in which we may not be able to.
Content
You are strictly prohibited from using any of Sana Cloud’s services for any unlawful purpose. This agreement is governed by the laws of Florida and the USA. The local regulations of the location in which you are hosting also apply if it is our Europe or Asia division.
The client is responsible for protecting Sana Cloud from any legal action that may arise as a consequence of using our services.
It is strictly forbidden to use our services in a way that violates any copyright or trademark. Theft of any protected work, including but not limited to books, photos, music, and other works, is also considered theft. Your account will be immediately terminated if you propose to sell any counterfeit items of a trademark holder. We will promptly remove or disable access to any account that is determined to be infringing upon someone else’s copyright. You may be subject to account termination and an administrative fine if your account is determined to be in persistent violation of copyright laws. Send an email to support@sanacloudsol.com with a legitimate DMCA request if you suspect any infringement on your copyright or trademark. Additional paperwork may be required in the event that the request pertains to a licensing matter.
It is strictly forbidden to use a shared account for backup purposes. Our servers will destroy any backups, including those via cPanel, that violate this policy.

Only authorized customers are allowed to use Sana Cloud services, including with all associated equipment, networks, and network devices. For all legitimate reasons, including managing the system, preventing unwanted access, and verifying security protocols, survivability, and operational security, Sana Cloud systems may be monitored. Information may be reviewed, recorded, copied, and utilized for approved reasons during monitoring. By using any Sana Cloud system(s), you are giving your consent to be monitored for these reasons.
Your account may be suspended if it is discovered that you have connected to a third party’s network or system without their permission. You must obtain the third party’s explicit written consent before you can access their networks or systems. Depending on the situation, Sana Cloud may ask for or demand proof of authorization to access a third party’s network or system.
We have the authority to deny service to anybody at any time. We reserve the right to remove or prohibit access to any content on our servers, with or without prior notice, if we determine that such content is offensive, harmful, unlawful, or otherwise violates our terms of service.
Your services may be suspended or terminated if you do not react to emails from our abuse department within 48 hours. Within 48 hours of submitting a troubleticket or email regarding an abuse concern, you will receive a response.
All sites hosted on Sana Cloud’s servers are subject to the laws of the United States of America. We do not remove allegedly defamatory information from domains hosted on our service(s) due to this fact and in accordance with Section 230(c) of the Communications Decency Act. A court judgment establishing that the content is defamatory would be the sole circumstance in which this requirement would be relaxed. We trust the legal system and courts to decide if material is really defamatory because Sana Cloud.com cannot examine and validate or invalidate the validity of individual defamation allegations. Access to any content that a court finds to be defamatory, libellous, or slanderous will be disabled. Also, we shall comply with any injunctions issued by US courts over specific pieces of content or materials by removing or disabling access to such items.
Webhosts like Sana Cloud and many more businesses owned by Sana Cloud are essentially defined as re-publishers rather than publishers under the Communications Decency Act’s Section 230(c) wording. Each third-party user is entirely responsible for their own content production and publication on our services; our service just offers a hosting platform and space to host material. Thus, Sana Cloud is not responsible for any purportedly harassing, defamatory, or offensive content that is housed on Sana Cloud’s servers.

No anything that could cause harm to children, such as child pornography or anything that could be interpreted as child pornography (Lolita), is allowed.
We will suspend without warning any site that is found to host or link to child pornography.
If you are a reseller, we will suspend the offending site and let you know so you can cancel your account. We will closely monitor your activities. If you commit more than one infringement of this type, your account may be terminated immediately.
Direct customers: Your service may be abruptly or gradually discontinued.
The FBI will be notified of any violations.
No matter how you install scripts or applications, it is your duty to make sure that directory permissions are configured correctly and that any scripts or programs installed under your account are secure. Most directories should have permissions set to 755, or the most restrictive setting you can find. In the end, users must pay for everything that happens under their account. Passwords and other login credentials are part of this category. Using a strong password is mandatory. You risk having your account suspended unless you change to a stronger password. To ensure that insecure passwords are not being used, audits can be conducted. We will let you know and give you time to reset or update your password if an audit finds that it is weak.
Strict Policy Against Spam
Sending unsolicited email, bulk emailing, or spam is something we will not abide. All purchased lists and so-called “safe lists” will be deemed spam. Without prior notice, we will terminate the account of any user found to be sending out spam.
We do not host any sites that are advertised by SPAM (Spamvertised). Spam transmitted through fax, phone, regular mail, email, instant messaging, or usenet/newsgroups is encompassed under this regulation. Our servers are not to be used by any entity or organization that is listed in the ROKSO. We shall promptly suspend or terminate any account that causes our IP space to be banned.
Only our VPS platform allows bulk email, and all US rules pertaining to spam, including the CAN-SPAM act, must be followed.
Any website, account, database, or other component that does not adhere to Sana Cloud’s defined policies may be required to make changes or disabled as needed. Sana Cloud retains the right to make any such alterations in an emergency at its sole discretion.
If Sana Cloud determines that an account has sent unsolicited email, it may impose a clean up fee or charge for blacklist removal on the account holder. The amount of the cleanup fee is totally subject to Sana Cloud’s discretion.
Information about Payment
Prior to the commencement of the service period, you are obligated to pay Sana Cloud the necessary amount for the services rendered. All services will continue to be invoiced on a recurrent basis until you inform Sana Cloud that you want to cancel them.
It is your obligation as a Sana Cloud customer to pay any bills in a timely manner and with accurate information. You acknowledge and agree that Sana Cloud will continue to charge you for the services until you inform them in writing that you would want to cancel any or all of them (using the methods specified in the relevant part of the Terms of Service). Ten days before the due date, Sana Cloud may charge the card or billing information that is on file with us. There is a twenty-day grace period from the date of invoice generation until payment is due with Sana Cloud. If an invoice is not paid within 9 days, a $2.00 late fee will be applied and/or the account will be suspended until the full amount is paid. In addition to any other amounts due to Sana Cloud for services provided, a $2.00 late fee will be levied. Once payment is received, you will be able to regain access to your account. The consumer runs the danger of having some of their services turned off until all of their bills are paid in full.
Ten days prior to the renewal date, you will get a charge for the renewal of your domain. Renewing a domain does not entitle you to a refund. The sale of domain names and their renewals is final. We will attempt to register the name once money is received, but there is no guarantee that you will really receive the domain when you purchase a new domain. A member of our support staff will contact you if there is a problem with your registration.
When an account’s payment is more than 30 days overdue, our servers will erase it. If there is a backup available, there is a $25.00 cost to reinstate an account that has been suspended or cancelled. Every new account will be charged the current costs listed on our website, regardless of any special pricing that you may have received on your previous account.
The amount of the monthly payment and any additional costs might be changed at any moment by Sana Cloud.
There will be a $150 chargeback fee for any refund requests made to Sana Cloud.
Data Protection and Backup
When you use this service, you do it entirely at your own risk. We are happy to assist you with this matter. Whatever information you store on Sana Cloud, we cannot be held liable for it. It is your duty to ensure that all data and files sent to Sana Cloud are adequately backed up and that you bear full responsibility for any data or files lost during transfer. Through the cPanel interface, you have the capability to create your own backups.
Decisions on Cancellation and Refunds
No prior notification is required for Sana Cloud to terminate, suspend, or impose other restrictions on the account.
You will lose access to our services and be unable to get a refund if you abuse our employees in any way.

With Sana Cloud’s reseller and managed shared hosting solutions, you can get your money back within 45 days. A seven-day money-back guarantee is available for dedicated (VPS) servers.
Dedicated (VPS) servers, administrative costs, add-ons (such dedicated IPs), domain name purchases, and install fees for custom software are non-refundable.
Our money-back promise is only applicable to new accounts. You cannot get a refund, for instance, if you had an existing account with us, canceled it, and then re-enrolled. The same goes for creating a second account with us.
There will be no more refunds given after the first 45 days.
Refunds will not be given out in cases where the Terms of Service are violated.
Utilization of Resources
Not allowed:
. Spend more than three quarters of your maximum system resources for more than ninety seconds. A wide variety of actions, such as those using CGI scripts, FTP, PHP scripts, HTTP, etc., could potentially lead to such issues.
. Use the server at any moment to run standalone, unattended programs. All daemons, including IRCD, fall under this category.
. On shared servers, you can run any site spider or indexer, including Google Cash and AdSpy.
. Launch any program that enables communication through an Internet Relay Chat (IRC) network.
. Launch any server, client, or tracker for bit torrents. Our shared servers are not for . hosting or storing illegal torrents, but you are free to link to them off-site.
. Join in on any P2P or file-sharing events
. Manage a server for any first-person shooter, shooter, etc.
. Execute cron tasks at intervals shorter than fifteen minutes.
. Take more than 15 seconds to execute any MySQL query. It is important to index MySQL tables correctly.
. Instead of including the URL, simply include the local file when using the PHP include functions to include a local file. You should use include(“include.php”) instead of include(“http://yourdomain.com/include.php”).
. If you’re in need of a backup provider, we recommend Dropbox.com, which you can save on your account.
. You can upload videos with a file size of more than 250 MB to your account.
. Feel free to invite your loved ones to join your account. You can only use your account to manage your websites.
. Keep any files that aren’t related to their Sana Cloud website on their account. (Another website’s media file storage)
Inodes
Anyone using more than 250,000 inodes on a shared account may receive a warning before their account is suspended if they do not take action. Our backup system will remove accounts that go over the 100,000 inode limit automatically to prevent over-usage. There is a one-inode limit for each type of file stored on your account.
We will not suspend sites that just go above our inode limitations. However, accounts that regularly create and remove huge quantities of files, have hundreds of thousands of files, or cause file system damage may be flagged for review and/or suspension. Leaving the catchall address enabled without ever verifying the primary account mailbox appears to be the main reason for excessive inodes. At some point, the account will have received tens of thousands of mails, if not more, exceeding our inode limit. Click “Mail,” then “Default Address,” “Set Default Address,” and finally enter: : to disable your default mailbox in cPanel.stop: This user does not exist.
Guaranteed Uptime
A one-month credit will be applied to your account in the event that your reseller or shared server has physical outage that falls below of the 99.9% uptime guarantee. Sana Cloud reserves the right to reject the credit application without proper explanation. For several reasons, such as the monitor’s network capacity and transit availability, reports from third-party monitoring services cannot be utilized as justification. Server uptime is the sum of all reported uptimes, which may vary from one service to another, but is always based on the OS and Apache Web Server. Get in touch with support@sanacloudsol.com and provide a reason for requesting a credit. Please submit any requests in writing by email. Only shared or reseller solutions are eligible for uptime guarantees.
Responsibility of the Client: Reseller
It is the reseller’s responsibility to assist their customers. Our resellers’ clients do not receive service from Sana Cloud. In the event that a customer of a reseller contacts us, we retain the right to suspend the customer’s account until the reseller can take over the client’s responsibilities. For reasons of security, the reseller must submit all support requests on behalf of their clients. The content stored or transferred under a reseller’s account, as well as their clients’, are the reseller’s responsibility. Any reseller who has customers that break the law or the terms of service will be held accountable by Sana Cloud.
Discount vouchers
Except when otherwise stated, discounts and coupon codes cannot be applied to the purchase of domain registrations and are exclusively available to first-time accounts *or first-time customers*. You can’t use the same discount to re-register for the same domain after you’ve already signed up. Our sales staff will investigate any account discovered to be in breach of these policies and will thereafter add the necessary invoices to the account. Misuse of coupons is strictly prohibited and may lead to account suspension or termination.
Alternative Dispute Resolution
The use of any Sana Cloud service constitutes your consent to be bound by arbitration. An arbitrator appointed by Sana Cloud shall hear any claims or disputes that may emerge against the company or any of its subsidiaries. Here in Florida, we’ll pick an arbitrator from either the NAFA or the National Arbitration Forum. According to the relevant regulations, arbitrators must be either practicing attorneys or retired judges. An arbitrator’s ruling is final and binding on all parties. No party may challenge or appeal the arbitrator’s decision. This Arbitration Clause establishes the federal arbitration statute as the governing law for all arbitrations, rather than any state statute. The expense of any arbitration hearing will also be your responsibility.
Disclaimer
Any harm that may come to your company is not the responsibility of Sana Cloud. The services offered by Sana Cloud are not guaranteed in any way, either expressly or impliedly. When it comes to merchantability and fitness for a particular purpose, Sana Cloud isn’t making any promises. Data loss due to service outages, incorrect deliveries, or delays in delivery is encompassed under this policy.
Customer Data & Information
An internal customer register will be used to store the information that the customer provides when registering with Sana Cloud. Private information is safeguarded. The customer acknowledges and agrees that Sana Cloud will use this information for the purposes of communicating with the parties depicted in the flow diagram (Appendix 1). If Sana Cloud has access to the correct contact information and the customer provides erroneous information, Sana Cloud has the right and obligation to update the current information. If the customer has multiple accounts with Sana Cloud, Sana Cloud is entitled and obligated to combine all of the customer’s accounts into one for administrative reasons. You might have to pay an administrative fee.
The Customer is aware that any personally identifiable information they submit while registering a domain name will be made publicly available online at the designated Sana Cloud Registration Unit. Customers can see the following details if they disable “Whois Privacy”: My name, my email, and my domain name. Just to illustrate: There will be a shared presence and processing of personal data between Sana Cloud and the.com registry holder in the event that a customer registers a.com domain. The onus is on the Customer to notify any relevant parties within their organization of the aforementioned, and to ensure that they have the necessary authority to handle Personal Data as described above.
When asked, Sana Cloud would only share personal information with the proper authorities, not the register.

Sharing Information with Law Enforcement
Sana Cloud reserves the right, upon legitimate request from law enforcement agencies, to provide subscriber information to such agencies without additional notice or consent. All necessary cooperation will be extended to law enforcement.
Change to the TOS
Without prior warning, Sana Cloud may change its policies at any moment.
